Terms and Conditions of the Astro Berries Service

§1. Introduction
- These terms and conditions (hereinafter: the "Terms") set out the rules of operation and conditions of use of the Astro Berries website, available at the addresses: `astroberries.com` and `astro.coloursofsamadhi.com` (hereinafter jointly: the "Service"), operated by Colours of Samadhi Sp. z o.o. with its registered office in Warsaw, ul. Lanciego 12/97, 02-792 Warsaw, Poland, NIP: 9512597744, REGON: 528808348, KRS 0001109196, entered into the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, XIII Commercial Division of the National Court Register, share capital PLN 5000, e-mail address: help@coloursofsamadhi.com (hereinafter: the "Service Provider").
- The Privacy Policy of Astro Berries forms an integral part of these Terms.
- The Terms form an integral part of the agreement concluded by the Customer with the Service Provider in connection with the use of the Service.
- Astro Berries is a separate line of the Service Provider's services, independent of the services provided within the coloursofsamadhi.pl website (yoga classes, courses, workshops). The provisions of the coloursofsamadhi.pl terms do not apply to the services described in these Terms.
- A Customer of the Service may be only a natural person who is at least 18 years old and has full legal capacity, a legal person, or an organizational unit without legal personality to which the law grants legal capacity.

§2. Glossary
- Service – the Astro Berries website, available at `astroberries.com` and `astro.coloursofsamadhi.com`, enabling the generation of astrological horoscopes and conversations with a virtual astrologer based on artificial intelligence.
- Service Provider – Colours of Samadhi Sp. z o.o., details as in §1.
- Customer (also "User") – a natural person with full legal capacity who is at least 18 years old, a legal person, or an organizational unit without legal personality, using the Service.
- Consumer – a Customer who is a natural person concluding an agreement with the Service Provider not directly related to their business or professional activity.
- Entrepreneur with Consumer rights – a Customer who is a natural person concluding an agreement with the Service Provider directly related to their business activity, where the content of that agreement indicates that it does not have a professional character for that person, resulting in particular from the subject of the business activity they carry out, made available under the provisions on the Central Registration and Information on Business (CEIDG).
- Horoscope – a set of digital content generated by the Service based on data provided by the Customer, comprising the Natal File and – depending on the selected variant – the Forecast File. The Customer may generate a Horoscope without a Forecast File (Portrait without forecast).
- Natal File – digital content generated once, containing planetary positions, astrological houses, aspects, elements, numerological data, and Vedic (Jyotish) astrology data, including the Dasha period, at the moment of birth/inception of the subject of the Horoscope. If the Customer indicates that they do not know the exact time of birth/inception, the Natal File is computed for the midpoint of the uncertainty range indicated by the Customer, and elements that depend on the exact time (the ascendant, astrological houses, the precise degree of the Moon, and indications dependent on them) are marked as approximate; this does not constitute a rectification service (determining the exact time of birth).
- Forecast File – optional digital content generated once, containing planetary transits for a period selected by the Customer, no longer than 5 years, and within the Vedic system also Dasha and Sade Sati. The Customer may choose the forecast range or forgo the Forecast File (Portrait without forecast).
- Relationship Portrait (Synastry) – digital content comparing two Natal Files (inter-chart aspects, house overlays, and Vedic astrology elements), generated based on the data of two subjects of the Horoscope provided by the Customer. The Vedic astrology elements of the Relationship Portrait include, in particular, a compatibility analysis (Guna Milan / Ashtakoot), Mangal (Kuja) Dosha, and a comparison of the Moon nakshatras of both subjects. The Customer may optionally add to the Relationship Portrait a relationship forecast – digital content covering transits of slow-moving planets to the relational points of both subjects and a comparison of the Dasha periods of both subjects, for a period selected by the Customer not exceeding 5 years.
- AI Astrologer – a virtual conversation partner (chatbot) based on artificial intelligence models, provided within the Service for the purpose of conversing about the meaning of the generated Horoscope. The AI Astrologer appears in two personas – Richard and Elizabeth – differing in conversational style. Individual personas may use models from different providers (currently: a model supplied by Anthropic for the Richard persona and a model supplied by Google for the Elizabeth persona); the current list of providers is set out in the Privacy Policy of Astro Berries. The Service Provider may make available additional AI Astrologer personas, including test personas with a limited circle of access, using models from the same providers. The AI Astrologer is not a human.
- Token – a billing unit in the Service, entitling the Customer to use a specific paid function, in particular one message exchange with the AI Astrologer (one query and response) as described in the Service. In the Service interface, Tokens are presented as "berries". Tokens do not constitute electronic money, a payment instrument, or a currency within the meaning of applicable law and are not exchangeable for cash; they serve solely to access the paid functions of the Service.
- Token Package – a specified number of Tokens offered for purchase at one Price, as described in the Service.
- Balance – the current number of unused Tokens assigned to the Customer Account.
- Customer Account – a set of resources assigned to the Customer's e-mail address, enabling access to the history of generated Horoscopes, saved conversations, and the Balance.
- Magic Link – a one-time internet link sent to the Customer's e-mail address, used to log in to the Customer Account without a password, valid for 15 minutes from the moment of sending.
- Price – the amount the Customer is obliged to pay for the purchase of a Token Package, expressed in the currency selected by the Customer in accordance with §6.
- Base Price – the price of one Token in the basic (smallest) Token Package, applied to the settlements referred to in §7.
- Agreement – an agreement for the provision of a digital service (purchase of a Token Package and use of the Service's functions) concluded remotely between the Service Provider and the Customer via the Service.
- Moon calendar – optional digital content that the Customer may add to a Horoscope, covering short-term indications regarding the transiting Moon relative to the Natal File (sign ingresses, lunar phases, aspects to natal positions, void-of-course periods), with times in the timezone applicable to the Customer. The moon calendar is of an informational and entertainment character only and does not constitute electional guidance (choosing "good days") or any form of advice.
§3. Nature and subject of the Service
- The Service enables:
- the generation of a Natal File and – optionally – a Forecast File based on data provided by the Customer (date and time of birth/inception, place of birth, optionally place of residence);
- the generation of a Relationship Portrait (Synastry) based on the data of two subjects, together with an optional relationship forecast for a period not exceeding 5 years;
- downloading the generated files in text format (TXT/ZIP) and downloading a record of the conversation with the AI Astrologer in PDF format;
- conducting a conversation with the AI Astrologer (in the Richard or Elizabeth persona) about the content of the generated Horoscope;
- optionally adding a moon calendar (a short-term layer of Moon transits) to the Horoscope, as described in the Service;
- optionally (with the Customer's prior, voluntary consent) receiving e-mail notifications about key transits and a weekly summary of the lunar rhythm relating to the Customer's own Horoscope; a calendar file in `.ics` format may be attached to such messages. These notifications are disabled by default, and the Customer may opt out at any time using the unsubscribe link included in every message or via the Customer Account settings.
- The Service combines the approach of Western (tropical) and Vedic (sidereal, Jyotish) astrology.
- Informational and entertainment character. The Customer acknowledges and accepts that:
- the content generated by the Service, including the Horoscope and the AI Astrologer's responses, is of an exclusively informational and entertainment character;
- this content does not constitute medical, psychological, financial, legal, investment, or any other professional advice;
- astrology is not a science within the meaning of scientific methodology, and the Service Provider makes no representations as to the truthfulness, accuracy, or verifiability of the content generated by the Service;
- any life, health, financial, professional, or personal decisions made by the Customer on the basis of content generated by the Service are made solely at the Customer's own responsibility and risk.
- The AI Astrologer is an artificial intelligence system, not a human. The AI Astrologer does not replace a psychologist, therapist, physician, financial advisor, or lawyer.
- Within a given conversation, the AI Astrologer uses only the data of the Horoscope to which that conversation relates and – in order to ensure continuity – a concise summary of the Customer's earlier conversations concerning the same Horoscope. The AI Astrologer has no access to the internet or to other Customers' data.
§4. Safety Mechanism in Conversations with the AI Astrologer
- The Service Provider makes efforts to ensure that the AI Astrologer (in each of its personas) recognizes, in the content of the Customer's messages, signals indicating a mental health crisis, suicidal ideation, or intent of self-harm.
- If such signals are recognized, the AI Astrologer interrupts the astrology-related conversation and provides the Customer with information about free support — a suicide or mental-health crisis helpline operating in the Customer’s country (which the Customer can find e.g. at findahelpline.com or by searching online for a crisis or suicide helpline together with the name of their country) — and encourages contact with a physician, psychologist, or the nearest support facility.
- The mechanism described in paragraphs 1–2 operates through automated, real-time analysis of message content while a response is being generated. The Service Provider does not carry out manual monitoring or review of Customers' conversations; the rules for storing conversation content (including its encryption) are set out in §8 and the Privacy Policy.
- This mechanism is supportive in nature and does not replace professional medical or psychological help. The Service Provider does not guarantee that the AI Astrologer will recognize every crisis signal, due to the inherent limitations of artificial intelligence technology.
- If the Customer or a third party is in immediate danger to life or health, the local emergency number should be contacted without delay (112 across the European Union, or the emergency number for the Customer’s country).
§5. Model of using the Service
- Free use. Generating a Horoscope does not require registration or providing an e-mail address. The Natal File and Forecast File are available for download free of charge. Conversation with the AI Astrologer is, within the free scope, limited by a message limit set by the Service Provider. Once the limit is exhausted, the Service informs about the possibility of purchasing a Token Package. During the Service's testing period, access to certain functions (including file downloads) may be temporarily restricted, in particular protected by an access password; the Service provides information about such a restriction in the appropriate place, and this provision ceases to apply once the restrictions are lifted.
- Customer Account. The Customer may create a Customer Account via a registration form (providing an e-mail address, first name, last name, and password, and declaring that they are at least 18 years old); an Account may also be created automatically upon the first use of an e-mail address by the Customer (e.g. during the payment process). Logging in is done using a password; alternatively, the Customer may log in without a password using a Magic Link. The Service Provider provides a password recovery (reset) mechanism. After logging in, the Customer has access to a panel with a list of their own previously generated Horoscopes, saved conversations, and their Balance.
- Tokens. After purchasing a Token Package, the corresponding number of Tokens is added to the Customer's Balance. Using Tokens enables the use of the Service's paid functions, in particular conversation with the AI Astrologer beyond the free limit and access to a Forecast of the selected range, as described in the Service. Each use of a paid function reduces the Balance by the corresponding number of Tokens. The number of Tokens charged per message exchange may depend on the length of the conversation, the selected forecast range, the relationship forecast, and the inclusion of a moon calendar, as described in the Service.
- Validity of Tokens. Tokens have no expiry date and do not expire as long as the Customer Account remains active. Anonymization of an inactive Customer Account in accordance with §8a results in the loss of the unused Balance.
§6. Conclusion of the Agreement and payment
- The conclusion of an Agreement for the purchase of a Token Package occurs through the Customer making a payment via the Service. Making a payment requires logging in to the Customer Account.
- Payments are handled via the ING Pay service (formerly imoje), provided by ING Bank Śląski S.A. with its registered office in Katowice, ul. Sokolska 34, 40-086 Katowice, KRS 0000005459, NIP 634-013-54-75. Transactions are carried out using payment links generated by the ING Pay service — after selecting a Token Package, the Customer is redirected to the bank's page to make the payment. The Customer's payment card data is not processed by the Service Provider's servers.
- The available payment methods are indicated in the Service at the payment stage (in particular: BLIK, Visa/Mastercard payment cards, Google Pay, online transfers).
- Prices in the Service are expressed in Polish zloty (PLN) and – where the Service makes this available – in other currencies indicated in the Service, depending on the Customer's choice, and are total (gross) prices — the Price indicated in the Service is the full amount the Customer is obliged to pay. Regardless of the payment currency, the Service Provider's settlement and accounting currency remains the Polish zloty (PLN); conversions are made in accordance with applicable regulations.
- The Agreement is concluded at the moment of obtaining a positive payment authorization, after which the corresponding number of Tokens is added to the Customer's Balance. The Customer is informed of this in the Service and by electronic means at the e-mail address assigned to the Account.
- The Service Provider benefits from a subjective exemption from value-added tax (VAT); prices do not include VAT. The Service Provider is not obliged to issue an invoice unless the Customer requests one within 3 months from the end of the month in which the Service was performed or payment was received. Upon a request submitted within this period, the Service Provider issues an invoice (without VAT — exemption) and sends it to the indicated e-mail address. To issue an invoice, the Customer provides the data necessary to prepare it.
- No physical delivery and no delivery costs. The subject of the Agreement is solely the provision of digital content (the Token Package and access to the Service's functionalities), supplied by electronic means. The Service does not offer any physical goods and does not carry out physical delivery. Accordingly, the Customer does not incur any delivery costs — the total cost borne by the Customer is solely the Price indicated in the Service at the point of purchase. Purchased Tokens are added to the Customer's Balance immediately after a positive payment authorization is obtained, with no need to receive any shipment.
§7. Right of withdrawal from the Agreement
- A Customer who is a Consumer, and on analogous terms also an Entrepreneur with Consumer rights, has the right to withdraw from an Agreement for the purchase of a Token Package concluded remotely within 14 days of its conclusion, without giving a reason.
- The purchase of a Token Package and the use of the Service's paid functions constitutes a service consisting in the supply of digital content not recorded on a tangible medium. The Customer acknowledges that the use of a Token (using a paid function) means the commencement of the performance of the service.
- Before making a payment, the Customer consents to the commencement of performance (the ability to use Tokens) before the expiry of the withdrawal period and acknowledges that, in accordance with Article 38(13) of the Act of 30 May 2014 on Consumer Rights, they lose the right of withdrawal from the Agreement with respect to Tokens already used.
- In the event of withdrawal from the Agreement within the period referred to in paragraph 1:
- with respect to unused Tokens — the Service Provider returns to the Customer the part of the Price corresponding to the unused Tokens;
- with respect to Tokens used before withdrawal — the Customer bears the cost corresponding to the number of used Tokens, valued at the Base Price; the refund is reduced by this amount.
- The Service Provider makes the refund without delay, no later than within 14 days of receiving the withdrawal statement, using the same payment method used by the Customer, unless the Customer has expressly agreed to another method of refund that does not involve any costs for them.
- The Customer may submit a withdrawal statement electronically to: help@coloursofsamadhi.com.
- The provisions of this section do not limit other mandatory rights of the Consumer or Entrepreneur with Consumer rights.
§8. Data entered by the Customer and rules for its storage
- In order to generate a Horoscope, the Customer provides: first name/last name (of a person) or name (of a company/event), date and time of birth/inception, place of birth. Optionally, the Customer may provide a place of residence (if different from the place of birth) and an e-mail address. To generate a Relationship Portrait (Synastry), the Customer provides the relevant data of two subjects. Providing data is voluntary but is necessary to generate the Horoscope and perform the Agreement to the extent indicated in the Privacy Policy of Astro Berries.
- The data indicated in paragraph 1, the generated Natal File, and Forecast File are stored permanently by the Service Provider, which enables them to be made available again to the Customer (in particular within the Customer Account).
- The content of the Customer's conversations with the AI Astrologer is stored by the Service Provider in the Service's database in order to enable the Customer to resume and continue earlier conversations, maintain continuity between conversations, and download a record of a conversation in PDF format. Conversation content is stored in encrypted form. The Customer may at any time delete a generated Horoscope together with its associated conversations in the Customer Account panel; deleting a Horoscope results in the deletion of the associated conversations. Conversation content is also subject to anonymization or deletion in accordance with §8a and the Privacy Policy.
- The Customer is obliged to provide truthful data. Where the Customer provides the data of a third party (in particular to generate a Relationship Portrait), the Customer declares that they are authorized to provide such data. The Service Provider is not obliged to verify the truthfulness and correctness of the data provided by the Customer. The Customer is responsible for providing false data and for providing third-party data without an appropriate legal basis.
- Detailed rules for processing the Customer's personal data are set out in the Privacy Policy of Astro Berries.
- The Service Provider applies technical and organizational measures to protect the Customer's data and the security of the Account, in particular: encryption of AI Astrologer conversation content in the database, storage of passwords solely as cryptographic hashes, optional two-factor authentication (2FA), access control restricting access to Horoscopes and conversations to their owner only, transmission of data over an encrypted connection (HTTPS), and protection against cross-site request forgery (CSRF). Passwordless login (Magic Link) serves solely to log in to an existing Customer Account and does not create a new Account.
§8a. Inactive Customer Accounts
- The Service Provider has the right to anonymize a Customer Account that remains inactive continuously for a period longer than 3 years. Inactivity is understood as the absence of login to the Account and the absence of other Customer activity in the Service during that period.
- Before anonymization, the Service Provider will make efforts to notify the Customer at the e-mail address assigned to the Account, at least 30 days in advance, allowing the Account to be kept active.
- Anonymization consists in the permanent deletion or removal of personal data of features enabling the identification of the Customer, including the deletion of generated Horoscopes and conversation content. Anonymization of the Account results in the loss of access to generated Horoscopes and the loss of the unused Token Balance.
- Data that the Service Provider is obliged to retain under legal provisions (in particular transaction data for accounting and tax purposes) is retained for the period required by those provisions, regardless of the anonymization of the Account.
§9. Technical requirements
To use the Service, a device with internet access is required, equipped with an up-to-date web browser supported by its manufacturer, with cookies and JavaScript enabled. Access to the e-mail inbox indicated by the Customer is required to create and use a Customer Account.
§10. Complaints
- The Service Provider is obliged to provide the Services in accordance with the concluded Agreement.
- The Service Provider is liable towards the Consumer and the Entrepreneur with Consumer rights for a lack of conformity of the Service with the Agreement existing at the time of its performance and revealed within two years of that moment, on the terms set out in the Act of 30 May 2014 on Consumer Rights.
- If a lack of conformity of the Service with the Agreement is found, in particular its improper performance (e.g. malfunction of the Service, significant discrepancy of the Service from its description in the Service), the Customer has the right to file a complaint. As part of a complaint, the Customer may demand that the Service be brought into conformity with the Agreement, a reduction of the Price, and in cases provided for by law — withdrawal from the Agreement.
- Complaints should be submitted electronically to: help@coloursofsamadhi.com or in writing to the Service Provider's registered office.
- A complaint should contain at least: the Customer's first and last name, data enabling identification of the Agreement (e.g. date of purchase, e-mail address assigned to the Account), a detailed description of the objections raised, the Customer's request related to the complaint, and the preferred method of contact.
- The Service Provider examines the complaint within 14 days of its receipt. Failure to respond within this period to a Consumer or Entrepreneur with Consumer rights is deemed acceptance of the complaint.
- The Consumer and the Entrepreneur with Consumer rights have the possibility of using out-of-court methods of handling complaints and pursuing claims, including via the EU ODR platform, available at: https://ec.europa.eu/consumers/odr.
§11. Liability of the Service Provider
- The Service Provider makes efforts to ensure that the Service operates correctly and continuously, but does not guarantee uninterrupted and error-free operation of the Service, in particular in the event of technical breaks, maintenance work, or circumstances beyond the Service Provider's control (e.g. unavailability of external providers referred to in §12).
- The Service Provider is not liable for the content and correctness of geographic data (coordinates) returned by the external geocoding service, to the extent this results from the limitations of that service.
- Subject to paragraph 4, the Service Provider's liability towards the Customer for non-performance or improper performance of the Agreement is limited to the amount of the Price paid by the Customer for the Token Package to which the non-performance or improper performance relates.
- The provisions of this section do not exclude or limit the Service Provider's liability in cases where such limitation would be inconsistent with mandatory legal provisions, in particular towards Consumers and Entrepreneurs with Consumer rights, and in no case exclude liability for damage caused to the Customer intentionally.
§12. Third parties used in the Service
- To provide the Service, the Service Provider uses the following third parties:
- Railway Corporation – hosting of the application and the Service's database;
- Anthropic – provider of the artificial intelligence model used by the AI Astrologer (Richard persona);
- Google – provider of the artificial intelligence model used by the AI Astrologer (Elizabeth persona);
- Nominatim/OpenStreetMap – geocoding of the place of birth/residence provided by the Customer;
- ING Bank Śląski S.A. / ING Pay (formerly imoje) – payment handling;
- Resend – sending e-mail messages (Magic Link, confirmations, Account-related messages).
- The detailed scope of data transferred to individual entities is set out in the Privacy Policy of Astro Berries.
- The Service Provider reserves the right to change the entities indicated in paragraph 1, in particular to ensure continuity or security of the Service, of which it will inform through an update of the Privacy Policy of Astro Berries.
§13. Availability of the Service, law and jurisdiction
- The Service is available globally; however, the Service Provider reserves the right to limit or disable the availability of the Service with respect to selected countries or regions, in particular if required by the law in force in a given country or if providing the Service in a given market would involve significant legal risk for the Service Provider.
- The law applicable to the Agreement and these Terms is Polish law.
- Any disputes arising from the Agreement shall be resolved by the court competent under the provisions of applicable Polish law, subject to the reservation that the Consumer may always benefit from the protection provided by the mandatory provisions of the law of the country of their habitual residence, if those provisions are more favorable to them.
- This section does not deprive the Consumer of the protection granted to them under provisions that cannot be excluded by agreement, in accordance with the law of the state in which the Consumer has their habitual residence.
§14. Age of users
- Only persons who are at least 18 years old may use the Service.
- By placing an Order or using the Service, the Customer declares that they are at least 18 years old.
- The Service Provider does not verify the Customer's age by technical means. If the Service Provider obtains credible information that the Customer is a minor, it reserves the right to block that person's access to the Service.
§15. Software used for astronomical calculations
- The Service uses the Swiss Ephemeris library for astronomical calculations (planetary positions, houses, aspects), authored by Dieter Koch and Alois Treindl, the rights to which belong to Astrodienst AG, Zollikon, Switzerland.
- The Service Provider uses the Swiss Ephemeris library under the GNU Affero General Public License (AGPL v3). In accordance with the terms of this license, the Service Provider will, upon request, make available to an interested person the source code of the Service component that integrates with the Swiss Ephemeris library and performs astronomical calculations, to the extent required by the AGPL v3 license.
- A request to make the source code referred to in paragraph 2 available should be submitted to the e-mail address: help@coloursofsamadhi.com.
- The Service Provider reserves that the exact scope of components subject to disclosure under AGPL v3 may be the subject of separate verification in light of the current architecture of the Service and the applicable provisions of the license.
- Notwithstanding the provisions of paragraphs 1–4, the copyrights to the content, mechanisms, and graphic elements of the Service, apart from the components indicated in paragraph 1, belong to the Service Provider or entities with which the Service Provider has concluded appropriate agreements.
§16. Final provisions
- In matters not regulated by these Terms, the generally applicable provisions of Polish law apply.
- The Service Provider reserves the possibility of introducing changes to the Terms. Customers holding a Customer Account will be informed of any change by electronic means, at the e-mail address assigned to the Account.
- Agreements concluded before a change to the Terms comes into force are governed by the provisions in force at the time the given Agreement was concluded.
- The Terms in version V1.8 are effective from the date indicated at the beginning (21.07.2026).
Note on language versions: These Terms have also been prepared in an English version. In the event of any discrepancies between the Polish and English versions, the Polish version prevails, as the Agreement is governed by Polish law.
